1. Acceptance of Terms
By installing or using the CompBuddy mobile application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not install or use the App.
These Terms constitute a legally binding agreement between you and Rainer Dieterle ("we", "us", or "our"), the developer and operator of CompBuddy.
2. Description of Service
CompBuddy is a mobile application designed to support the safety management and logistics of paragliding competitions. Its features include:
- GPS position sharing with the competition safety team
- Retrieve request and coordination tools
- Real-time messaging between pilots and competition staff
- Competition task notifications and checkpoint tracking
- Pilot registration and check-in management
The App is intended for use by registered pilots and authorised staff participating in competitions that have adopted the CompBuddy platform.
3. Eligibility
You may use CompBuddy only if:
- You are a registered participant or authorised staff member of a competition using the CompBuddy platform, and
- You are at least 13 years of age (or the minimum age required by law in your jurisdiction).
By using the App, you represent and warrant that you meet these eligibility requirements.
4. Safety Disclaimer
Location data and status information displayed in the App may be subject to delays, GPS errors, or connectivity interruptions. The App should not be used as the sole basis for safety decisions.
Participation in paragliding competitions involves inherent risks. CompBuddy does not reduce or eliminate these risks and makes no warranty that the App will function without interruption in all environmental or network conditions.
5. User Responsibilities
When using CompBuddy, you agree to:
- Provide accurate information during registration and onboarding.
- Keep your device charged and connected to mobile data during competition tasks so that safety tracking functions correctly.
- Grant the location permissions required for background tracking if you are participating as a pilot.
- Not attempt to falsify, spoof, or manipulate GPS data transmitted through the App.
- Not use the App to harass, impersonate, or harm other participants or staff.
- Not reverse-engineer, decompile, or tamper with the App or its API.
- Comply with all applicable laws and competition regulations.
6. Intellectual Property
All intellectual property rights in the CompBuddy App, including its design, code, graphics, and documentation, are owned by Rainer Dieterle. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose during your participation in an eligible competition.
You may not copy, modify, distribute, sell, or create derivative works based on the App or any part of it without prior written permission.
7. Privacy
Your use of CompBuddy is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App you consent to the data practices described in the Privacy Policy, including the collection and transmission of your precise location.
8. Third-Party Services
CompBuddy integrates with third-party services, including:
- Google Firebase — for push notifications. Use is subject to the Google Terms of Service.
- AirTribune — for competition registration data.
- WhatsApp — for the pilot registration flow. Use is subject to WhatsApp's Terms of Service.
We are not responsible for the availability, accuracy, or practices of these third-party services.
9. Disclaimer of Warranties
CompBuddy is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The App will be available continuously or error-free.
- Location data will be accurate or delivered in real time under all network conditions.
- The App will function on all devices or operating system versions.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Rainer Dieterle shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, CompBuddy — including but not limited to damages arising from inaccurate location data, missed notifications, or service interruptions.
In any case, our total liability to you for any claim arising out of or relating to these Terms or your use of the App shall not exceed the amount you paid (if any) for the App in the twelve months preceding the claim.
Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities; to the extent such exclusions or limitations are not permitted, they shall not apply.
11. Termination
We reserve the right to suspend or terminate your access to CompBuddy at any time, without notice, if you violate these Terms or engage in conduct that is harmful to other users, competition staff, or the operation of the service.
You may stop using the App at any time by uninstalling it from your device.
12. Changes to These Terms
We may update these Terms from time to time. The updated version will be published at this URL with a revised effective date. Your continued use of CompBuddy after the updated Terms are published constitutes your acceptance of the changes. If you do not agree to the revised Terms, stop using the App.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of CompBuddy shall be subject to the exclusive jurisdiction of the courts of Germany.
If you are a consumer resident in another EU member state, you may also be entitled to the mandatory consumer protection laws of your country of residence.
